My name is Attorney Fabio Loscerbo, and today we are talking about posted workers and residence permits in Italy. A recent decision issued by the Regional Administrative Court of Marche on April 11, 2026 addressed an important issue affecting many foreign workers transferred to Italy through international posting procedures. In this case, an Albanian citizen had legally entered Italy with a special work visa under Article 27 of the Italian Immigration Act. He was employed as a highly specialized worker by a company connected to the Italian host company. When his residence permit expired, he applied for renewal.
However, the Immigration Office rejected the request because the extension of the authorization issued by the Single Immigration Desk had not been formally produced. The Court ruled in favor of the worker. According to the judges, the actual employment relationship cannot be ignored. The worker had continued working for the same company, had obtained a permanent employment contract, and the maximum five-year period allowed by Italian law for this type of posting had not yet expired. The Court also affirmed an important principle: when a missing administrative document can be directly obtained by public authorities, the administration must cooperate instead of automatically rejecting the application. Another key aspect of the judgment concerns the definition of “highly specialized worker.” The Court clarified that this category does not apply only to executives and managers, but may also include skilled technical workers with advanced professional expertise. This decision could have significant consequences for many foreign workers who entered Italy through international posting procedures. That’s all for today.
